1. Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
  2. To the extent of any inconsistency between these Terms and Conditions and any other reference to this competition, these Terms and Conditions prevail.
Who can enter
  1. Entry is only open to individuals aged 18 or over living in Australia. Employees (and their immediate families) of the Promoter, participating retailers and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

How to enter
  1. During the Promotional Period the Promoter will run a commercial (“Commercial”) digitally – via the Wattyl website as well as on Facebook and/or Instagram. After seeing the Commercial, individuals will:
    1. Visit www.Wattyl.com.au/Test-Lab
    2. Correctly answer the question – “Tell us where the hidden white lab coat is located?” (i.e., in or near what item?). This will be multiple choice - A. It’s on the mannequin; B. It’s in the laundry basket in the bathroom; C. It’s hanging on the crib in the baby’s room; D. It’s being used as a throw on Barry’s chair.
    3. Enter their personal details including, but not limited to, full name, email address, postal address, phone and nearest store
    4. If the question is answered correctly the Entrant will be placed in the Draw
    5. Entrants can choose to receive an additional entry into the Draw. If they enter and “Like” the Wattyl Facebook page and continue to “Like” it until the Draw, they will receive one additional entry in the Draw. In the event they answered 5b wrongly and “Like” the Wattyl Facebook page they will receive only one entry into the draw. The Wattyl Facebook page is: www.facebook.com/wattylpaint
  2. All Entrants can choose to sign up to Paint Perks and regularly receive emails from Wattyl. This is not a mandatory component of the competition. To do this Entrants must also agree to the Paint Perks Membership Terms and Conditions.
  3. All entrants who correctly answer the question in 5b and provide a correct email address will receive a discount voucher (“Voucher”) to use at their local Wattyl Paint Centre. This voucher:
    1. Is $20 off when you spend $100 or more. Capped at $20 discount.
    2. Voucher is only applicable when shelf price is paid; no other discount is valid. Note: NO Paint Perks offer/s can be used with this voucher.
    3. Only valid at Wattyl Paint Centres in Australia
    4. Valid on all Paints and Stains and accessories, excluding spray equipment and spray accessories
    5. Valid until 29/02/20
    6. Trade accounts are excluded
    7. Voucher will be provided by email. To use the voucher, Entrants need to either print the voucher or just show their phone with the email on the screen at the Register.
  4. Limit of one entry per email address. The total maximum entries are two (2) – as per 5e.
  5. Entrants may only enter in their own name. Inaudible, incomprehensible, illegible, and incomplete entries may be deemed invalid. Only those entries received by the Promoter will be included in the competition draw.
  6. The Promoter reserves the right, in its sole discretion, to reject any entries which do not comply with these Terms and Conditions and will not provide any reasons for rejection. Entries that do not comply with these Terms and Conditions of entry will be deemed invalid and are not eligible to win a prize.
When to enter and promotion draw
  1. The Promotion Period commences 28/10/19 and closes on 24/11/19 at 11:59pm AEDST. (“Promotional Period”). The Commercial may not run for that entire duration; however, it will still be able to be viewed on Wattyl’s Facebook, Instagram pages and website.
  2. There will be one (1) draw (“Draw”) conducted from all the entries received. All entries will be divided into the following State groups QLD/NT, NSW/ACT, VIC/TAS, SA and WA. The first entry drawn from each State group will be deemed a Winner. The Winners will be drawn at Unit 40, 1-5 Thew Parade, CROMER NSW 2099 on 29/11/2019 & 11:00AM AEDST.
  3. The winners will be notified by phone within two business days of the draw, followed by notification in writing. Their names will also be published on 06/12/2019 in the public notices section of The Australian.
  4. All times noted in these Terms and Conditions are AEDST. Entries must be received by the Promoter prior to the close date and time of the Promotional Period to be eligible to win a prize.
Number of Entries permitted
  1. Multiple entries permitted, provided that each entry complies with these Terms and Conditions.
Prize on offer:
  1. Each winner will receive the following Prize (the prizes include two components):
    1. $1600 (including GST) of Wattyl branded paint (includes paint and stains, excludes accessories)
      1. Prize is to be claimed at the Winner’s nearest Wattyl Paint Centre in Australia. At the time of winning, the Promoter will confirm the Winner’s nearest store (Nominated Store).
      2. $1600 (incl GST) is based on cost retail customer will pay. Any Paint Perks or Retail store discounts are valid. Trade prices excluded.
      3. If the Winner’s nearest store is less than 50km away:
        An account will be set up in their name at the Nominated Store and the $1600 credit applied. This credit can be used all in one transaction, or progressively. $1600 expires 30/06/20, any funds remaining on the account after this date will be forfeited.
      4. If the Winner’s nearest store is more than 50km away:
        An account will be set up in their name at the Nominated Store and the $1600 credit applied. The Winner is to contact the store to arrange what they want to purchase. The Nominated Store will collate the order and deliver to the Customer. The Customer will not be charged anything for delivery. Please allow up to 7 days for delivery. This credit will all need to be used in one transaction (as Winner will only receive one deliverdelivery service). $1600 expires 30/06/20, any funds remaining on the account after this date will be forfeited.
      5. The Winner will receive their prize credit, to the Promoter’s best endeavours within 24 hours of the Winner and Promoter confirming their nearest store. Any delay outside the Promoter’s control may mean that it can be up to 14 days until the prize credit is applied. Note, all stores will have reduced trading hours due to summer holidays.
    2. A Wattyl approved painter (“Painter”) to paint a room of your residence, maximum size room 6m x 5m x 3m high walls to a Level 3 Standard finish.
      1. Room will be painted in a maximum of three colours – a limit of one colour for walls, a limit of one colour for ceilings and a limit of one colour for the trim.
      2. Wattyl will allocate the Painter based on the Winner’s location. Wattyl will advise Painter by 31/01/20. The Winner and Painter are to mutually book in date/time for painting by 28/02/20 with the painting complete by 30/06/20.
      3. The paint used will come from the Winner’s Prize in 16a. Any additional paint the winner will keep.
      4. The Painter will arrange a consultation with the winner to discuss the room condition before any work will be carried out and will highlight any items that require the winner's attention before the painter commences.
      5. The condition of the walls within the chosen room: a substrate must be properly prepared to Australian Industry Standards. Must be a previously painted interior wall (does not apply to any newly built homes) and only applicable to: previously painted paper-face plasterboard, fibre cement, set plaster, timber panelling or MDF.
      6. The painter will repair minor defects such as holes from picture hook fixing or slight wall indentation from wear and tear but will not cover any repairs needed due to any size through holes, cracks, peeling blistering or flaked walls. Minor gap filling and sanding will be covered but any repairs the painter deems to be a carpenter required task must be covered at the owners own time and cost before painting can commence.
      7. The painter will supply all floor covering but will not be responsible for moving of any furniture.
      8. Any walls that require any plastering repairs will be done so at the owner's expense and be prepared ready for painting. Note: major imperfection such as holes or cracks. The Prize does not include any removal of any wallpaper, or preparation required to wall that has previously had wallpapering applied. All skirting, trims and architraves must be securely fixed to existing walls as no repairs of this nature will be covered by our painter. Any repairs to doors must be made prior to painting as only minor repairs such as robe hook screw holes will be covered by our painters. No aluminium windows will be painted. Excludes specialty finishes.
      9. It is the winner’s responsibility to organise any approvals from landlords, home owners etc.
      10. Wattyl will provide the Winner with instructions to Prep the room based on the above inclusions and exclusions. For any wet area such as kitchen, bathrooms or laundries, any mould effected areas must be treated prior to prepping. Any residue oil, stains (from water, tobacco, or smoke damaged) must also be removed prior to prepping. It is the Winner’s responsibility to Prep accordingly. If this isn’t completed the Winner may forfeit prize 16 (b) or have prep occur at Winner’s expense.
      11. Prize RRP is up to $1000 (including GST).
    3. A Colour Consultant
      1. A 90 minute colour consult by a Colour Consultant to assist with your choice of colours. The Colour Consultant will be only available to visit the Winner’s home if the winner is within a 20km radius of the location of the Colour Consultant.
      2. In the event the Winner lives further than 20km from their Colour Consultant they can choose to either:
        1. Have a 90 minute colour consult over email and phone
      3. Colour Consultant valued at up to $262.50 (including GST).
  2. Each prize is valued up to $2862.50 (including GST). Total prize pool is up to AUD $14312.50 (including GST).
  3. Prizes are not transferrable, nor redeemable for cash.
  4. The Promoter will not be liable for a winner who cannot be contacted after making reasonable attempts and therefore forfeits the Prize and no correspondence will be entered into.
  5. If the Promoter is unable to contact a winner to claim a prize or if the winner is unable to use any element of a prize, the winner will forfeit the prize in its entirety and the Promoter may, in its absolute discretion, select a replacement winner from the valid entries.
  6. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
  7. Incomplete or indecipherable entries will be deemed invalid.
  8. If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
  9. The Promoter reserves the right to conduct a redraw in the event of an entrant, claiming to be a winner, being unable to satisfy these Terms and Conditions.
  10. The judges' decision in relation to any aspect of the competition is final and binding on each person who enters. No correspondence will be entered into. No responsibility is accepted for late, lost or misdirected entries. All prizes are subject to availability, not transferable or exchangeable for cash.
  11. Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
  12. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant and (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion.
  13. Any cost associated with accessing the promotional website or SMS service is the entrant’s responsibility and is dependent on the Telecommunications provided and / or Internet service provider used. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
  14. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
  15. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (f) any tax liability incurred by a winner or entrant; or (g) use of a prize.
  16. The Promoter collects personal information ("PI") in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at www.wattyl.com.au/en/privacy-policy. In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. The Privacy Policy also contains information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter. The Promoter will not disclose entrant’s personal information to any entity outside of Australia.
