“TERMS AND CONDITIONS"

  1. Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
  2. To the extent of any inconsistency between these Terms and Conditions and any other reference to this competition, these Terms and Conditions prevail.

Who can enter

  1. Entry is only open to individuals aged 18 or over living in Australia. Employees (and their immediate families) of the Promoter, participating retailers and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
  2. The Promoter is HEMPEL (WATTYL) AUSTRALIA PTY LTD (ABN 40 000 035 914) (the ‘Promoter’). The Promoter’s address is Level 3, 2 Burbank Place Norwest Business Park, Baulkham Hills NSW 2153.
How to enter
  1. During the Promotional Period the Promoter will run a commercial (“Commercial”) digitally – via the Wattyl website as well as on Facebook and/or Instagram. After seeing the Commercial, individuals will:
    1. Visit www.wattyl.com.au/testlabentry
    2. Correctly answer the question – “Tell us where the misplaced helicopter keys are located?” (i.e., in or near what item?). This will be multiple choice – A, B, C or D
    3. Enter their personal details including, but not limited to, full name, email address, residential address and phone
    4. If the question is answered correctly the Entrant will be placed in the Draw
  2. All Entrants can choose to sign up to Paint Perks and regularly receive emails from Wattyl. This is not a mandatory component of the competition. To do this Entrants must also agree to the Paint Perks Membership Terms and Conditions. Anyone who subscribes to Paint Perks can choose to unsubscribe at any time.
  3. Limit of one successful entry per email address per week. The total maximum successful entries are eight (8). Entries reset at 12:01am AEDT every Monday. There is a limit of one invalid entry per day, and one valid entry per week.
  4. Entrants may only enter in their own name. Inaudible, incomprehensible, illegible, and incomplete entries may be deemed invalid. Only those entries received by the Promoter will be included in the competition draw.
  5. The Promoter reserves the right, in its sole discretion, to reject any entries which do not comply with these Terms and Conditions and will not provide any reasons for rejection. Entries that do not comply with these Terms and Conditions of entry will be deemed invalid and are not eligible to win a prize.
When to enter and promotion draw
  1. The Promotion Period commences 31/01/22 at 9:00am AEDT and closes on 27/03/22 at 11:59pm AEDT. (“Promotional Period”). The Commercial may not run for that entire duration; however, it will still be able to be viewed on Wattyl’s Facebook, Instagram pages and website.
  2. The Draws will comprise of eight (8) Minor Prize Draws and two (2) Major Prize Draws. Subject to Clause 21 all non-winning entries will roll into remaining draws. (“Draw”) The first entry drawn will be deemed a Winner. The Winners will be drawn at Unit 40, 1-5 Thew Parade CROMER NSW 2099 based on the schedule below:

  1. The winners will be notified by phone within four business days of the draw, followed by notification in writing. Their names will also be published at www.wattyl.com.au/testlabentry (and may also be published on Wattyl’s Facebook and/or Instagram) on within seven days of the Draw.
  2. All times noted in these Terms and Conditions are AEDT. Entries must be received by the Promoter prior to the close date and time of the Promotional Period to be eligible to win a prize.
Number of Entries permitted
  1. Multiple entries permitted, provided that each entry complies with these Terms and Conditions.
Prize on offer:
  1. Each Major Prize Winner will receive a Major Prize comprising of the following:
    1. A Piper Cubby House, supplied by Hip Kids (full details available here: www.hipkids.com.au/collections/wooden-cubby-houses-for-kids/products/piper-cubby-house)
      1. Item is flat packed, and can be erected by one person in approx. one hour (as per Hip Kids recommendation)
      2. Item arrives unpainted
      3. Item arrives via courier to Winner’s home address; delivery can take up to 4 weeks and may be left unattended. Alternatively, delivery can be made to a depot and the Winner can collect from there. If the Winner chooses to collect from a depot, any costs relating to the collection and delivery from depot to Winner’s home are the responsibility of the Winner.
      4. Item does not include:
        1. Floor/Base. We strongly suggest that ‘Piper’ be fixed on a timber joisted marine plywood floor or concrete/paved 100% level floor
        2. Any furniture, décor or decorations
        3. Silicon for weatherproofing, Tools – Screwdriver (cordless powered screwdriver is recommended, Ladder for assembly (to fit roof)
    2. A Wattyl Solagard Paint and accessories pack including:
      1. Colour 1: Roof (Winner’s Choice): Solagard Satin 2L
      2. Colour 2: Trims (Winner’s Choice): Solagard Gloss 1L
      3. Colour 3: Walls exterior (Winner’s Choice): Solagard Satin Low Sheen 4L
      4. Colour 4: Walls floors interior (Winner’s Choice): Solagard Low Sheen 4L
      5. A selection of 3 x brushes, 3 x drop sheets and 2 x paint trays
      6. Items will be available for delivery direct to Winner’s home address or collection from their local Wattyl PaintCentre. If delivery is arranged, items will arrive separately to the Cubby House delivery. Allow 4 weeks fromcolour selection for paint delivery
      7. Colour selection: It is the Winner’s responsibility to choose the colours they wish to paint their Prize. The Promoter will provide a range of suggested colour schemes, and the Winner can decide to use one of these or create their own. If the Winner chooses their own, it is their responsibility (and the Winner is subject to any cost they may incur) to source their own colour samples, sample pots and/or research. If the Winner chooses a suggested colour scheme from the Promoter, it is the Winner’s responsibility (and the Winner is subject to any cost they may incur) to source their own colour samples, sample pots and/or research as colours may look different on screen to when painter. The Promoter accepts no responsibility for slight variations in colour from screen to actual.
  2. Each Minor Prize Winner will receive a Minor Prize comprising of the following:
    1. A Kids Sand Water / Picnic Table, supplied by Hip Kids (full details available here: www.hipkids.com.au/collections/outdoor-equipment/products/sand-and-water-kids-picnic-table-w-umbrella)
      1. Item arrives unpainted
      2. Item arrives via courier to Winner’s home address; delivery can take up to 4 weeks and may be left unattended. Alternatively, delivery can be made to a depot and the winner can collect from there.
    2. A Wattyl Solagard Paint and accessories pack including:
      1. Colour 1 (Winner’s Choice): Solagard Low Sheen 2L
      2. Colour 2 (Winner’s Choice): Solagard Low Sheen 2L
      3. A selection of 2 x brushes, 2 x drop sheets and 2 x paint trays
      4. Items will be available for delivery direct to Winner’s home address or collection from their local Wattyl Paint Centre. If delivery is arranged, items will arrive separately to the Cubby House delivery. Allow 4 weeks from colour selection for paint delivery
      5. Colour selection: It is the Winner’s responsibility to choose the colours they wish to paint their Prize. The Promoter will provide a range of suggested colour schemes, and the Winner can decide to use one of these or create their own.   3. Each Major Prize is valued at $1578.40 (including GST), depending on location for delivery. Each Minor Prize is valued at $449.35 (including GST), depending on location for delivery. Total prize pool is up to AUD $6751.60 (including GST), depending on location for delivery.
  4. Winners are responsible for painting, building and/or assembly and are responsible for any costs to prepare the surface prior to installation. Winners are responsible for any costs associated with the enjoyment of the prize.
  5. Prizes are not transferrable, nor redeemable for cash.
  6. Any prize warranty claim will be subject to Hip Kids Warranty (www.hipkids.com.au/pages/warranty-returns-policy)
  7. There will be a limit of one Major Prize and one Minor Prize per household regardless of how many entries are placed (excluding SA).
  8. The Promoter will not be liable for a winner who cannot be contacted after making reasonable attempts and therefore forfeits the Prize and no correspondence will be entered into.
  9. If the Promoter is unable to contact a winner to claim a prize or if the winner is unable to use any element of a prize, the winner will forfeit the prize in its entirety and the Promoter may, in its absolute discretion, select a replacement winner from the valid entries.
  10. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
  11. Incomplete or indecipherable entries will be deemed invalid.
  12. If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
  13. The Promoter reserves the right to conduct a redraw in the event of an entrant, claiming to be a winner, being unable to satisfy these Terms and Conditions.
  14. The judges’ decision in relation to any aspect of the competition is final and binding on each person who enters. No correspondence will be entered into. No responsibility is accepted for late, lost or misdirected entries. All prizes are subject to availability, not transferable or exchangeable for cash.
  15. Entrants consent to the Promoter using the entrant’s name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter. The Promoter may ask the winner to provide additional photos and/or video of them using the prize. The Promoter may, with permission choose to share these on their social channels and in e-newsletters. It is the Winner’s discretion to provide permission, however the Promoter will not provide any payment for such usage.
  16. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant and (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion.
  17. Any cost associated with accessing the promotional website or SMS service is the entrant’s responsibility and is dependent on the Telecommunications provided and / or Internet service provider used. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
  18. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
  19. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (f) any tax liability incurred by a winner or entrant; or (g) use of a prize.
  20. The Promoter collects personal information (“PI”) in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at www.wattyl.com.au/privacy-policy. In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. The Privacy Policy also contains information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter. The Promoter will not disclose entrant’s personal information to any entity outside of Australia.
